TERMS AND CONDITIONS

IMPORTANT LEGAL NOTICE: These Terms and Conditions constitute a legally binding agreement between you and QRSIFR. By accessing the QRSIFR website, mobile application, or any associated services, you confirm that you have read, understood, and unconditionally agree to these Terms. If you do not agree, you must immediately cease using the platform. 

1. Definitions 

For the purposes of these Terms and Conditions, the following definitions shall apply: 

  • “QRSiFR,” “the Platform,” “we,” “our,” or “us” — refers to the QRSIFR website, application, and all associated digital properties operated under www.qrsifr.com. 

  • “User,” “Customer,” or “you” — any individual or entity accessing, browsing, registering on, or transacting through the Platform. 

  • “Seller” or “Merchant” — any third-party business, service provider, or individual who lists, offers, or supplies vouchers or experiences through the Platform. 

  • “Voucher” — any discounted deal, coupon, ticket, pass, booking credit, or redemption code purchased through the Platform. 

  • “Validity Period” — the specific start and end date and time printed on or associated with each Voucher, after which the Voucher is null, void, and non-refundable under any circumstances. 

  • “Owner” — the proprietor(s), shareholder(s), director(s), and/or founder(s) of QRSIFR, whether acting in a personal or corporate capacity. 

  • “Related Parties” — collectively, QRSIFR, the Owner, Sellers, agents, affiliates, partners, technology providers, payment processors, employees, and any other persons or entities associated with or connected to the Platform. 

2. Acceptance of Terms 

By using the QRSIFR Platform in any manner — including without limitation browsing, registering an account, purchasing a Voucher, or redeeming a Voucher — you agree to be fully and unconditionally bound by these Terms and Conditions, together with our Privacy Policy and any other policies or notices published on the Platform from time to time. 

These Terms apply to all Users regardless of location, nationality, or jurisdiction. QRSIFR reserves the right to amend these Terms at any time without prior notice. Continued use of the Platform following any amendment constitutes your acceptance of the revised Terms. 

3. Nature of the Platform and QRSIFR’s Role 

QRSIFR operates exclusively as an online marketplace and intermediary platform that facilitates the listing, discovery, and sale of discounted Vouchers across categories including, but not limited to: travel, accommodation, leisure, recreation, entertainment, dining, wellness, sports, adventure, events, and lifestyle experiences. 

QRSIFR is NOT a service provider, tour operator, hospitality provider, or experience deliverer. QRSIFR does not own, operate, manage, or control any of the services, experiences, venues, or activities for which Vouchers are sold on the Platform. The contractual relationship for service delivery exists solely between the Customer and the Seller. 

QRSIFR acts solely as a marketplace intermediary. The actual service or experience is provided exclusively by the Seller. QRSIFR makes no representations or guarantees regarding the quality, availability, safety, or legality of any Seller’s offerings. 

4. Voucher Purchases and Transactions 

4.1 Purchase Process 

All Voucher purchases made through the Platform are final subject to the Refund Policy set out in Section 6. By completing a purchase, you enter into a direct commercial transaction with the Seller for the underlying service or experience, and a separate payment transaction with QRSIFR as the collection agent on behalf of the Seller. 

4.2 Voucher Validity 

Each Voucher is subject to a specific Validity Period, which includes a defined start date, end date, and end time. The Validity Period is clearly stated on the Voucher at the time of purchase and in your confirmation email. It is your sole responsibility to: 

  • Read and understand the Validity Period before completing your purchase 

  • Redeem the Voucher within the stated Validity Period 

  • Contact the Seller in advance to book or confirm your appointment or reservation 

  • Monitor approaching expiry dates and take timely action 

QRSIFR shall bear no responsibility for any failure by the User to redeem a Voucher within its Validity Period, regardless of the reason. 

4.3 Voucher Redemption 

Vouchers must be redeemed directly with the Seller in accordance with the terms, conditions, and booking requirements specified by the Seller. QRSIFR does not guarantee the availability of the Seller’s services or any particular time slot, and is not liable for any failure by the Seller to honor a Voucher. 

5. Sellers and Merchant Obligations 

Sellers who list Vouchers on the Platform agree to honor valid, unexpired Vouchers purchased by Customers. However, QRSIFR does not warrant, guarantee, or ensure Seller compliance and shall bear no liability for: 

  • A Seller’s refusal or failure to honor a Voucher 

  • A Seller’s cessation of business, insolvency, or closure 

  • Changes to a Seller’s offerings, pricing, availability, or terms after Voucher purchase 

  • Any dispute, disagreement, or claim arising between the Customer and Seller 

  • The quality, accuracy, safety, or fitness for purpose of any service provided by a Seller 

Customers are solely responsible for verifying a Seller’s terms and conditions prior to purchase and contacting the Seller directly to resolve any service-related disputes. 

6. Refund Policy 

STRICT NO-REFUND POLICY APPLIES IN MOST CIRCUMSTANCES. READ THIS SECTION CAREFULLY BEFORE PURCHASING. 

6.1 General Refund Principle 

All Voucher sales on QRSIFR are generally non-refundable. A refund, where applicable, is a discretionary accommodation and not a right or entitlement. Any refund request is subject to the express prior written approval of the relevant Seller and to the deductions and conditions set out herein. 

6.2 Conditions for Refund Eligibility 

A refund request will only be considered if ALL of the following conditions are met simultaneously: 

  1. The refund request is submitted by the Customer via email to the official QRSIFR support email address. 

  1. The refund request email is received by QRSIFR no less than forty-eight (48) hours before the end of the Voucher’s Validity Period (i.e., before the stated expiry date and time on the Voucher). Requests received within 48 hours of expiry shall be automatically disqualified and rejected. 

  1. The Seller provides their express written approval for the refund. QRSIFR will liaise with the Seller on the Customer’s behalf, but cannot compel the Seller to approve any refund request. 

  1. The Voucher has not been redeemed, partially used, or presented for use at the Seller’s premises or platform. 

  1. The Customer provides full details of the purchase, including the order reference number, Voucher code, registered email address, and reasons for the refund request. 

Meeting the above conditions does not guarantee a refund. QRSIFR retains sole discretion to approve or reject any request in consultation with the Seller. 

6.3 Penalty and Processing Deductions 

In the event that a refund is approved by the Seller and QRSIFR, the refund amount paid to the Customer shall be subject to the following mandatory deductions: 

  • An administrative processing fee as notified to the Customer via email at the time the refund is assessed. 

  • Any applicable payment gateway or transaction fees incurred in processing the original purchase and/or the refund. 

  • A cancellation penalty charge as determined by the Seller and communicated to the Customer via email prior to processing the refund. 

  • Any other charges, fees, or deductions that QRSIFR or the Seller are entitled to impose under the specific Voucher’s terms. 

All deductions will be communicated to the Customer by email prior to processing. The Customer’s acceptance of the notified deductions is required before any refund is issued. The net refund amount after all deductions may be significantly less than the original purchase price. 

6.4 Refund Method 

Approved refunds, after all applicable deductions, will be processed via the original payment method used at the time of purchase, or by an alternative method as agreed in writing between QRSIFR and the Customer. Refund processing times are subject to the Customer’s bank or payment provider and may take up to 14 business days. 

6.5 Absolute No-Refund Circumstances 

THE FOLLOWING CIRCUMSTANCES RESULT IN AN ABSOLUTE, UNCONDITIONAL, AND NON-NEGOTIABLE REFUSAL OF ANY REFUND, WITHOUT EXCEPTION: 

  • The Voucher has expired (i.e., the Validity Period’s end date and/or end time has passed), regardless of the reason for non-use, including but not limited to illness, travel disruption, personal emergency, change of plans, or force majeure events. 

  • The refund request is submitted less than 48 hours before the Voucher’s expiry date and time. 

  • The Customer failed to attend, show up for, or present themselves at the Seller’s venue or service location on the agreed or booked date (“No-Show”). A No-Show is treated as a full use of the Voucher and no refund shall be issued. 

  • The Voucher has been fully or partially redeemed or used in any manner. 

  • The Seller has declined to approve the refund request. 

  • The Customer failed to book or confirm their appointment or reservation with the Seller within the Validity Period. 

  • The Voucher was purchased as part of a promotional, flash sale, limited-time offer, or clearly marked non-refundable deal. 

  • The Customer claims dissatisfaction with the Seller’s service, quality, or experience after redemption. 

For absolute clarity: the expiration of a Voucher’s Validity Period, for any reason whatsoever, results in the complete and irrevocable forfeiture of the Voucher and any monetary value associated with it. No exceptions will be made under any circumstances. 

7. Comprehensive Disclaimer of Liability 

THIS SECTION CONTAINS CRITICAL LIMITATIONS ON THE LIABILITY OF QRSIFR AND ALL RELATED PARTIES. READ IN FULL. 

7.1 General Disclaimer 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QRSIFR, THE OWNER, AND ALL RELATED PARTIES EXPRESSLY DISCLAIM ALL LIABILITY OF ANY KIND, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, EQUITY, OR ANY OTHER LEGAL OR EQUITABLE THEORY, FOR ANY LOSS, DAMAGE, INJURY, CLAIM, COST, OR EXPENSE OF ANY NATURE WHATSOEVER ARISING FROM OR CONNECTED TO: 

  • Your use of, or inability to use, the QRSIFR Platform or any Voucher purchased thereon 

  • Any act, omission, negligence, misconduct, fraud, insolvency, or default of any Seller or Merchant 

  • The quality, fitness for purpose, safety, legality, or availability of any service, experience, or product offered by a Seller 

  • Any cancellation, postponement, modification, or discontinuation of a Seller’s service or experience 

  • Any dispute between a Customer and a Seller arising from the redemption or non-redemption of a Voucher 

  • Any personal injury, death, property damage, financial loss, or consequential damage suffered in connection with any service obtained through a Voucher 

  • Any unauthorized access to or alteration of your account or personal data 

  • Any technical failures, server outages, security breaches, or data loss affecting the Platform 

  • Any inaccuracy, error, or omission in Voucher descriptions, pricing, or terms as listed on the Platform 

7.2 No Liability for Seller Actions 

QRSIFR bears no responsibility whatsoever for the conduct, actions, representations, warranties, or omissions of any Seller. QRSIFR does not endorse, vouch for, or guarantee any Seller listed on the Platform. By purchasing a Voucher, you acknowledge that your recourse for any service-related complaint lies exclusively against the Seller and not against QRSIFR. 

7.3 No Legal Complaints Against QRSIFR or the Owner 

By using the Platform and purchasing any Voucher, you expressly agree not to initiate, pursue, or threaten any legal action, claim, proceeding, arbitration, or complaint of any kind (including but not limited to civil, criminal, administrative, regulatory, or consumer protection proceedings) against QRSIFR, the Owner, or any Related Party, in any jurisdiction, arising from or connected to: 

  • Any transaction, Voucher purchase, refund decision, or dispute handled through the Platform 

  • Any loss, damage, or dissatisfaction arising from a Seller’s services 

  • Any refund rejection made in accordance with these Terms 

  • Any data security incident, privacy matter, or technical issue on the Platform 

You acknowledge and agree that the sole and exclusive remedy for any grievance arising from a Voucher transaction is to contact QRSIFR’s customer support team and, where relevant, to address your complaint directly with the Seller. 

7.4 Limitation of Liability Cap 

In jurisdictions where the complete exclusion of liability is not permitted by law, the total aggregate liability of QRSIFR to any User for any and all claims arising under these Terms shall not exceed the amount actually paid by the User for the specific Voucher giving rise to the claim. QRSIFR shall in no event be liable for indirect, incidental, special, punitive, exemplary, or consequential damages of any kind. 

7.5 Indemnification 

You agree to fully indemnify, defend, and hold harmless QRSIFR, the Owner, and all Related Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (i) your use of the Platform; (ii) your breach of these Terms; (iii) your violation of any applicable law or regulation; or (iv) any dispute between you and a Seller. 

8. Permitted Use of the Platform 

You agree to use the Platform solely for lawful personal purposes in accordance with these Terms. You shall not: 

  • Use the Platform for any commercial, resale, or unauthorized promotional purpose 

  • Attempt to circumvent any security, authentication, or access control measure on the Platform 

  • Upload, post, or transmit any content that is defamatory, fraudulent, abusive, or otherwise unlawful 

  • Engage in any conduct that could damage, overload, or impair the Platform’s functionality 

  • Use automated tools, bots, or scripts to access, scrape, or interact with the Platform 

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity 

9. Intellectual Property 

All content, trademarks, logos, graphics, software, data, and other materials on the QRSIFR Platform are the exclusive property of QRSIFR or its licensors and are protected by applicable intellectual property laws. No content from the Platform may be copied, reproduced, distributed, republished, displayed, or transmitted in any form without the prior written consent of QRSIFR. 

10. Account Registration and Responsibility 

Where account registration is required, you are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account. You must notify QRSIFR immediately of any unauthorized use of your account. QRSIFR shall not be liable for any loss or damage arising from your failure to safeguard your account credentials. 

QRSIFR reserves the right to suspend or permanently terminate any account without prior notice where a breach of these Terms is suspected or confirmed. 

11. Privacy 

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept the Privacy Policy. The Privacy Policy explains how we collect, use, and protect your personal data in accordance with applicable law including GDPR and U.S. privacy legislation. 

12. Third-Party Websites and Links 

The Platform may contain links to third-party websites, Seller pages, or partner platforms. QRSIFR does not endorse, control, or assume responsibility for any content, products, or services available on third-party websites. Accessing any third-party website is entirely at your own risk. 

13. Modifications to the Platform and Terms 

QRSIFR reserves the right, at its sole discretion and without prior notice, to: 

  • Modify, suspend, or discontinue any part of the Platform or any Voucher listing at any time 

  • Amend, update, or replace these Terms and Conditions at any time 

  • Remove any Seller, Voucher, or listing from the Platform without liability 

Continued use of the Platform following any such changes constitutes your binding acceptance of the updated Terms. It is your responsibility to review these Terms periodically. 

14. Governing Law and Dispute Resolution 

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which QRSIFR is incorporated or primarily operates, without regard to conflict of law principles. 

Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination, or invalidity thereof, shall first be submitted to QRSIFR’s internal dispute resolution process by contacting support@qrsifr.com. If unresolved within thirty (30) days, the parties agree to submit the dispute to binding arbitration or the competent courts of the applicable jurisdiction, as elected by QRSIFR. 

YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING AGAINST QRSIFR OR ANY RELATED PARTY. 

15. Severability and Entire Agreement 

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions, which shall continue in full force and effect. 

These Terms, together with the Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and QRSIFR with respect to your use of the Platform and supersede all prior agreements, understandings, or representations.

By purchasing a Voucher or using the QRSIFR Platform, you confirm that you are at least 18 years of age, have full legal capacity to enter into binding agreements, have read these Terms and Conditions in full, and agree to be bound by them unconditionally.
